Terms of Service

Please read these Terms of Service (“Terms”) carefully before using the Teaching Tutors platform. These Terms constitute a legally binding agreement between you and Teaching Tutors, LLC (“Teaching Tutors,” “we,” “us,” or “our”). Your use of the service constitutes your acceptance of these Terms in full.

1. Acceptance of Terms

By accessing or using Teaching Tutors (the “Service”), you agree to be bound by these Terms of Service and all applicable laws and regulations. If you do not agree with any part of these Terms, you must immediately discontinue your use of the Service. These Terms apply to all users of the Service, including browsers, registered users, subscribers, contributors, and any other users.

2. Description of Service

Teaching Tutors is a software-as-a-service (SaaS) education platform that provides interactive learning games, curriculum management tools, progress tracking, and supplementary educational resources for students. The platform is designed primarily to support homeschool families, tutors, and educators. The Service is subscription-based and accessible via a standard web browser. We reserve the right to modify, suspend, or discontinue any part of the Service at any time with or without notice.

3. Account Registration & Eligibility

To create an account, you must be at least 18 years of age, or you must have obtained verifiable parental or guardian consent if you are under 18. Parents and guardians serve as the account holders of record for any minor users. You agree to provide accurate, current, and complete information during registration and to keep your account information up to date.

Teaching Tutors is designed as a children's education application. Parents and guardians are solely responsible for their minor children's use of the Service, including monitoring all activity and ensuring that use of the Service is appropriate for the child's age and circumstances. You may not create an account on behalf of another person without their authorization.

4. Subscription Plans & Billing

Teaching Tutors offers multiple subscription tiers. Details of each plan's features and pricing are available on the pricing page within the Service.

  • Paid subscriptions are billed on either a monthly or annual basis, as selected at time of purchase.
  • Subscriptions automatically renew at the end of each billing period unless cancelled prior to the renewal date.
  • By subscribing, you authorize Teaching Tutors to charge your designated payment method on each applicable renewal date.
  • Prices are subject to change. We will provide advance notice of any price changes prior to your next renewal date.
  • You are responsible for all applicable taxes in your jurisdiction.

5. Refund Policy

📋 Refund Summary

Monthly subscriptions are non-refundable. Annual subscriptions are eligible for a prorated refund within the billing year.

  • Monthly plans: All monthly charges are final. You may cancel at any time; your access continues until the end of the current billing period with no refund issued for unused days.
  • Annual plans: If you cancel an annual subscription, you are eligible for a prorated refund of the unused portion of your billing year, provided at least 7 days remain in your current period. Refunds are calculated as: (days remaining ÷ total days in period) × amount paid.
  • How to request: Annual plan refunds can be requested directly from your Account page. The refund will be returned to your original payment method within 5–10 business days depending on your bank.
  • Trial periods: If you cancel during a free trial before providing a payment method, no charge is made and no refund is required.
  • Account termination: If Teaching Tutors terminates your account for a violation of these Terms, no refund will be issued regardless of billing cadence.
  • Processing fees: Payment processing fees (approximately 3%) are non-recoverable and are deducted from all refund calculations.

Teaching Tutors reserves the right to modify this refund policy at any time. Changes will apply to new subscriptions and renewals following the date of change. Active annual subscribers will be notified of any policy changes prior to their next renewal.

6. Free Trial Terms

🎓 14-Day Free Trial Available

Teaching Tutors offers a 14-day free trial on Solo and Family subscription plans. A valid payment method is required at checkout and will be charged automatically at the end of the trial period unless you cancel before it ends.

  • The free trial period begins on the date you activate a paid plan trial.
  • At the conclusion of the trial period, your payment method on file will be charged automatically for the chosen subscription unless you cancel before the trial ends.
  • If you do not subscribe before the trial ends, your account will automatically revert to the Free tier and paid features will become inaccessible.
  • Free trials are limited to one per account. Creating multiple accounts to circumvent this limitation is a violation of our Acceptable Use Policy.
  • Teaching Tutors reserves the right to modify or discontinue free trial offers at any time without notice.

7. Acceptable Use Policy

You agree to use the Service only for lawful purposes and in accordance with these Terms. You agree that you will not:

  • Use the Service for any illegal purpose or in violation of any local, state, national, or international law
  • Upload, transmit, or distribute any content that is unlawful, harmful, threatening, abusive, defamatory, obscene, or otherwise objectionable
  • Upload or transmit viruses, malware, or any other malicious code
  • Attempt to scrape, reverse-engineer, decompile, or disassemble any part of the Service or its underlying software
  • Share, sell, or transfer your account credentials to any third party
  • Harass, intimidate, or harm any other user or Teaching Tutors personnel
  • Use automated scripts or bots to access the Service
  • Circumvent or attempt to circumvent any access controls, security measures, or subscription restrictions
  • Interfere with the proper functioning of the Service or its infrastructure

Violation of this Acceptable Use Policy may result in immediate termination of your account, without notice and without refund.

8. Intellectual Property

Teaching Tutors, LLC retains all right, title, and interest in and to the Service, including but not limited to: the platform software, games, user interface design, user experience, brand identity, trademarks, logos, and all content created by Teaching Tutors. Nothing in these Terms transfers any ownership interest in the Service to you.

You retain all rights to any curriculum content, lesson data, and instructional materials that you upload to the Service (“Your Content”). By uploading Your Content, you grant Teaching Tutors, LLC a limited, non-exclusive, royalty-free license to host, store, process, and display Your Content solely to the extent necessary to provide the Service to you. This license terminates when you delete Your Content or close your account.

9. User-Generated Content

You are solely responsible for all curriculum content, lesson data, vocabulary lists, and other materials you upload, create, or store within the Service. By uploading such content, you represent and warrant that:

  • You own or have obtained all necessary rights, licenses, and permissions to upload and use such content
  • The content does not infringe the intellectual property rights, privacy rights, or any other rights of any third party
  • The content does not violate any applicable laws or regulations
  • The content is appropriate for use in an educational setting for minors

Teaching Tutors reserves the right to remove any content that violates these Terms or that we determine, in our sole discretion, to be harmful, offensive, or inappropriate.

10. Privacy & Data

Our collection, use, and protection of personal information is governed by our Privacy Policy, which is incorporated into these Terms by reference. By using Teaching Tutors, you consent to our data practices as described in the Privacy Policy.

We take the privacy of our users seriously, particularly given that our Service is used in connection with the education of minors. We implement industry-standard security measures to protect your data. Please review our Privacy Policy for full details on what data we collect, how we use it, and your rights as a data subject.

11. Limitation of Liability

TO THE MAXIMUM EXTENT PERMITTED BY APPLICABLE LAW, TEACHING TUTORS, LLC AND ITS OFFICERS, DIRECTORS, EMPLOYEES, AGENTS, SUPPLIERS, AND LICENSORS SHALL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, EXEMPLARY, OR PUNITIVE DAMAGES, OR ANY LOSS OF PROFITS, REVENUE, DATA, GOODWILL, OR OTHER INTANGIBLE LOSSES, ARISING OUT OF OR RELATED TO YOUR ACCESS TO OR USE OF (OR INABILITY TO ACCESS OR USE) THE SERVICE, EVEN IF TEACHING TUTORS HAS BEEN ADVISED OF THE POSSIBILITY OF SUCH DAMAGES.

In no event shall Teaching Tutors' aggregate liability to you for all claims arising out of or relating to these Terms or the Service exceed the greater of: (a) the total amount you paid to Teaching Tutors in the twelve (12) months immediately preceding the event giving rise to the claim, or (b) one hundred U.S. dollars ($100).

12. Disclaimer of Warranties

THE SERVICE IS PROVIDED “AS IS” AND “AS AVAILABLE” WITHOUT ANY WARRANTIES OF ANY KIND, EITHER EXPRESS OR IMPLIED. TO THE FULLEST EXTENT PERMITTED BY LAW, TEACHING TUTORS EXPRESSLY DISCLAIMS ALL WARRANTIES, INCLUDING BUT NOT LIMITED TO: IMPLIED WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, TITLE, AND NON-INFRINGEMENT.

Teaching Tutors does not warrant that the Service will be uninterrupted, timely, secure, or error-free; that defects will be corrected; or that the Service is free of viruses or other harmful components. Your use of the Service is at your sole risk.

13. Indemnification

You agree to defend, indemnify, and hold harmless Teaching Tutors, LLC and its officers, directors, employees, contractors, agents, licensors, and suppliers from and against any claims, liabilities, damages, judgments, awards, losses, costs, expenses, or fees (including reasonable attorneys' fees) arising out of or relating to:

  • Your violation of these Terms of Service
  • Your use or misuse of the Service
  • Your Content and any claims that Your Content infringes the rights of a third party
  • Your violation of any applicable law or regulation
  • Any claims by or relating to a minor user for whom you are the account holder

14. Termination

Teaching Tutors reserves the right to terminate or suspend your account and access to the Service at any time, with or without cause, and with or without notice, including for any violation of these Terms. Upon termination, your right to use the Service ceases immediately.

You may cancel your subscription at any time through your account settings. Upon cancellation, your access to paid features will continue through the end of your current billing period. Annual subscribers may be eligible for a prorated refund as described in Section 5 (Refund Policy); monthly subscribers are not entitled to a refund for any unused portion of the current billing period.

All provisions of these Terms that by their nature should survive termination shall survive, including without limitation: ownership provisions, warranty disclaimers, the refund policy, indemnity, and limitations of liability.

15. Governing Law

These Terms of Service shall be governed by and construed in accordance with the laws of the State of Missouri, United States of America, without regard to its conflict of law provisions. Any legal action or proceeding arising under these Terms shall be brought exclusively in the federal or state courts located in Missouri, and you hereby consent to the personal jurisdiction of such courts.

YOU AND TEACHING TUTORS AGREE THAT EACH MAY BRING CLAIMS AGAINST THE OTHER ONLY IN YOUR OR ITS INDIVIDUAL CAPACITY, AND NOT AS A PLAINTIFF OR CLASS MEMBER IN ANY PURPORTED CLASS OR REPRESENTATIVE PROCEEDING.

16. Changes to Terms

Teaching Tutors reserves the right to modify or replace these Terms at any time at our sole discretion. We will use commercially reasonable efforts to notify you of material changes via email to your registered address or via a prominent in-app notice at least 14 days prior to the changes taking effect.

Your continued use of the Service after the effective date of any changes constitutes your acceptance of the revised Terms. If you do not agree to the revised Terms, you must discontinue your use of the Service prior to the effective date. It is your responsibility to review these Terms periodically for updates.

17. Children's Privacy / COPPA

Teaching Tutors is designed as a tool for parents, guardians, and educators to manage learning content and track progress for minors. The platform is not directed at children under the age of 13, and we do not knowingly collect personal information directly from children under 13 without verifiable parental consent as required by the Children's Online Privacy Protection Act (“COPPA”) and other applicable laws.

Account holders — parents, guardians, and educators — are responsible for ensuring that all use of the Service by minors in their care is appropriate and compliant with applicable laws. The account holder, not the minor student, is the contracting party and the party whose personal information is collected.

If you believe that Teaching Tutors has inadvertently collected or received personal information from a child under 13 without proper parental consent, please contact us immediately. We will take prompt action to investigate and, if necessary, delete such information.
